AI-Assisted Works and Philippine Copyright: IPOPHL’s Proposed Human-Creativity Standard
The Intellectual Property Office of the Philippines (IPOPHL) is consulting stakeholders on proposed guidelines for artificial-intelligence systems and AI-related works. IPOPHL’s 17 September 2026 announcement explains that using an AI tool does not automatically prevent a work from being registered. The focus remains on whether the work contains original expression attributable to a human creator.
For creators and businesses, the distinction between using AI as a tool and relying on autonomous machine output may become significant. Human choices involving conception, selection, arrangement, revision, and final presentation can help demonstrate creative contribution. A prompt by itself may not fully show authorship, particularly when the final output reflects limited human control.
Businesses should preserve records of the creative process. Drafts, project files, prompt histories, source materials, editing logs, and written explanations of human decisions may help establish how a person shaped the finished work. Contracts with employees, agencies, designers, and technology vendors should address ownership, confidentiality, permitted inputs, warranties, and responsibility for possible infringement.
Registration and infringement are separate questions. Even if an AI-assisted work includes protectable human expression, it may still reproduce protected text, images, music, trademarks, personal data, or confidential material. A legal and factual review remains advisable before using AI-generated material in advertising, websites, software, publications, or branded products.
The guidelines remain a proposal undergoing consultation and should not yet be described as a final binding rule. Read IPOPHL’s official announcement. Businesses seeking Philippine setup and compliance assistance may contact BizzureVisa. This article provides general information only.
