BOI and PEZA Incentives: The CETI Attachment to the Annual Tax Return
BOI- or PEZA-registered status does not end a company’s tax documentation duties. An enterprise claiming an income-tax incentive should coordinate its investment-promotion-agency records with its annual income tax return and supporting attachments.
The BIR clarified the CETI requirement
BIR Revenue Memorandum Circular No. 42-2026 states that the Certificate of Entitlement to Tax Incentives, or CETI, remains a mandatory attachment to the Annual Income Tax Return of registered business enterprise taxpayers. It clarifies that RMC No. 20-2026 did not repeal that existing requirement. An RBE should review the full circular and the current filing instructions for its incentive regime.
Before filing, reconcile the approved activity, registration terms, incentive period, revenue and expense records, and certificate issued by the relevant investment promotion agency. A company should not assume that all revenue of a registered entity is covered by a project-specific incentive. Where several projects or activities exist, maintain distinct support for the claimed treatment.
Build an annual compliance calendar
Request the required certificate and internal reports in time for tax filing. Assign responsibility among the finance team, adviser and PEZA or BOI compliance personnel, and retain proof of submission. If a certificate is delayed, obtain advice on the proper filing approach rather than simply omitting the attachment.
Our business and investment services can help identify the registration and compliance sequence. Contact BizzureVisa with the registration certificate and tax year for a case-specific discussion.
General information only. Incentive entitlement and tax treatment depend on the project and current law.
