PEZA or BOI Registration? Choosing the Right Investment Promotion Agency in 2026
PEZA and the Board of Investments both administer investment-registration programs, but they serve different project structures. A foreign investor should identify the proposed activity, market, location, capital, and operating model before treating either agency as the default route.
PEZA registration is linked to an eligible ecozone project
PEZA rules allow qualified persons or entities to apply as export or free-trade enterprises, subject to nationality restrictions applicable to the activity. The project must fit an eligible enterprise category and operate in the appropriate economic-zone setting. Domestic-market, developer, utility, tourism, and service projects may face additional statutory ownership requirements.
BOI registration follows the SIPP
BOI registration depends on whether the proposed activity or project qualifies under the Strategic Investment Priority Plan. The government launched the 2026 SIPP on June 3, 2026 following Memorandum Order No. 47 and Official Gazette publication. Approval is project-specific; incorporation alone does not confer BOI incentives.
Incentives require continuing compliance
After approval, the investor completes pre-registration requirements, pays the applicable fee, and receives a certificate containing the terms of registration. The enterprise must comply with project commitments, reportorial duties, tax conditions, and rules governing the registered activity. Incentives should never be presented as an automatic blanket exemption.
Compare substance before location
The decision should consider export percentage, customers, supply chain, staffing, site, land or lease arrangements, foreign-ownership limits, and the type and duration of potential incentives. A tax comparison without operational facts can produce the wrong recommendation.
