Provisional Work Permit While a 9G Visa Is Pending
A foreign employee’s 9G visa application can take time. An employer should not assume that filing the petition itself authorizes the person to start work. Where the facts qualify, a Provisional Work Permit may provide a separate interim route while the appropriate visa is being processed.
What the BI describes
The Bureau of Immigration’s Provisional Work Permit service page sets out the application steps and current checklist. Operations Order No. JHM-2019-002 describes a PWP for work under the petitioning company pending approval of the appropriate visa, subject to its limits. Employers should check the latest BI rules and case-specific eligibility before relying on that order.
A PWP is distinct from a 9G visa and from an Alien Employment Permit issued under labor rules. The three address different legal questions. The employer should coordinate the DOLE and BI filings, ensure the job and corporate details match, and preserve evidence of each application and approval.
Track dates and scope
Review the worker’s present immigration status, PWP validity, 9G filing status, and permitted employer and role. Do not treat a provisional authorization as open-ended or transferable to a different company. If the visa is delayed, expires or is denied, obtain specific advice before work continues.
Our 9G visa services can help plan the application sequence. Contact BizzureVisa with the proposed role, employer and current visa details.
